There may be a disagreement between you and your employer and you may have lost, or are about to lose, your job. Milwyn Jenkins & Jenkins understand how stressful this can be. Employment law is a very wide and complex area of law which changes regularly. If, for instance, you feel you have been

The work may include:-

  • Taking your initial instructions, reviewing the papers and advising you on merits and likely compensation (this is likely to be revisited throughout the matter and subject to change)
  • Entering into pre-claim conciliation where this is mandatory to explore whether a settlement can be reached
  • Preparing your claim
  • Reviewing and advising the response from other party
  • Exploring settlement and negotiating settlement throughout the process
  • Preparing of a schedule of loss
  • Exchanging documents with the other party and agreeing a bundle of documents
  • Taking witness statements, drafting statements and agreeing their content with witnesses
  • Preparing bundle of documents
  • Reviewing and advising on the other party’s witness statements
  • Agreeing a list of issues, a chronology and/or case list
  • Preparation and attendance at Final Hearing, including instructions to Counsel (if necessary)

Will I have to go to ‘Court’?

Employment disputes are usually dealt with in a tribunal, if no agreement can be reached. It is Milwyn Jenkins & Jenkins' practice to consider all options for trying to resolve issues of this kind in order to minimise the stress in what is already a difficult situation and to keep the costs as low as possible. If a negotiated agreement is not possible, we can commence tribunal action and advise you of the need, where appropriate, for taking expert advice and a barrister’s opinion. Compromise Agreements are an effective method of resolving a variety of employment disputes and are an effective and viable method of avoiding legal proceedings with costs and monetary consequences for both parties. WILL I RECEIVE COMPENSATION?

This will depend upon the circumstances of your claim. If you would like Milwyn Jenkins & Jenkins to begin the process of assessing the merits and your chances of success, please book an appointment.

How long does it take?

It usually takes about 2 - 3 months to reach a negotiated settlement. A claim for unfair dismissal must be made within three months from the date of your dismissal. In Milwyn Jenkins & Jenkins' experience, most cases are dealt with within 5 – 6 months from when proceedings are commenced.

What will it cost?

All work we deal with in this regard are dealt with at an hourly rate as identified on the home page under Fixed Costs. Currently, there are no fees to apply to the Employment Tribunal. We would expect our fees to prepare the application to the Tribunal to provide initial advice to be in the region of £300 to £500 plus VAT (£360 to £600.00).

Litigation can be an expensive process. Contact us so that Milwyn Jenkins & Jenkins can look at all funding options e.g. legal expenses or ‘after the event’ insurance, ‘no win, no fee’, or paying privately. We are happy for you to pay our fees by instalments. Our priority will be to ensure that the value of your claim is not outweighed by costs.
