What is Conveyancing?

Conveyancing basically means the transfer of title to property – e.g. when you sell or buy your home (whether that be a freehold or leasehold title). This may or may not involve a mortgage. It could be by way of gift. Our lawyers at Milwyn Jenkins & Jenkins use a tried and tested set of procedures and forms to make this process as stress-free as possible for you, fully recognising that this will be one of the most important decisions you will ever make.

Buying by auction is quite different from a normal conveyancing transaction for the buyer and seller. For example, there is no “cooling off” period with an auction. As soon as the hammer falls on you bid, there is a commitment to buy, no matter what problems may later be found with the property. We can provide expert pre-auction advice to avoid such risks

The work will consist of the following:

(a)       investigating the title to the property, to include:

 (i)        carrying out searches with respect to title and local government information for the property;

(ii)        reviewing replies given by the seller to pre-contract enquiries, search results and title to the property;

(b)       confirming the terms of the purchase contract;

(c)        drafting a transfer deed;

(d)       advising you in respect of your mortgage offer;

(e)       preparing a report for you;

(f)        exchanging contracts and then completion of the purchase;

(g)       calculating stamp duty land tax (SDLT) on the purchase and preparing and submitting to HM Revenue & Customs the appropriate SDLT forms;

(h)       and transferring funds by telegraphic transfer to the seller’s solicitors; and

(i)         registering the purchase (and any associated mortgage) at the Land Registry.

What do I need to do next?

If you are a seller, you will need an Energy Performance Certificate before you market your property. Milwyn Jenkins & Jenkins can assist you in obtaining one. How long does it take?

Milwyn Jenkins & Jenkins aim to meet your timescale whenever possible whilst at the same time recognising that there are other parties to the transaction. Your interests will be our priority.  Transactions can varibly take between 4 to 12 weeks to complete.  Exchange of Contracts will usually be approximately 2 weeks before completion

What will it cost?

 Please see the Fixed costs as set out on our Home Page.  The disbursements will vary on each transaction, however, in a sale, there will be Land Registry fees of approximately £11.00 and a bank Transfer fee of £36 (inclusive of VAT @20%) and in a normal purchase the following fees:-

Usual Searches £170 (Inc VAT @ 20%)

Land Registration fees (these depend on the value of the property concernd)

Stamp Duty Land Tax or Land Transaction Tax ( these depend on the value of the proeprty concerned)

Land Registry searches (approx) £10.00

Bank Transfer fee £36.00 (Inc VAT @20%)
